BVAZ PARTICIPATION TERMS
Terms and Conditions.
These Terms and Conditions form part of each enrolment agreement between the Provider and the participant. The individual Season Confirmation specifies the programme, schedule and price. In case of conflict, the Season Confirmation prevails for those programme specific details.
Scope and contractual relationship
BVAZ provides beach volleyball coaching, training programmes, private sessions, camps, tournaments and related services. Participants purchase services from the Provider; enrolment does not create membership in an association, ownership rights or voting rights.
The agreement is concluded when BVAZ confirms the participant's place in writing and the participant accepts the Season Confirmation and these Terms and Conditions. BVAZ may require payment before the place becomes final.
For participants under 18, the agreement must be accepted by a parent or legal guardian, who is responsible for payment and required declarations.
Programme and schedule
The Season Confirmation states the assigned group, level, usual day and time, venue, season period, planned number or frequency of sessions and fee.
Training is offered as a seasonal programme. Public holidays, venue closures and planned breaks identified in the schedule are not training sessions unless expressly included.
BVAZ may replace the named coach, adjust the group composition and make reasonable changes to the venue or schedule where operationally necessary, provided that the essential character and overall value of the programme remain substantially equivalent. A specific coach is guaranteed only when expressly stated in the Season Confirmation.
Group placement and minimum participation
BVAZ determines group placement using sporting level, compatibility, availability, safety and training quality. Placement labels are internal guidance and do not guarantee a particular ranking or competitive result.
Before the programme begins, BVAZ may cancel, merge or propose changes to a group if the required minimum number of participants is not reached. The participant may accept the alternative. If no suitable alternative is accepted, amounts paid for the cancelled programme will be refunded.
Fees, invoicing and payment
The full seasonal fee is payable even when instalments are offered. Instalments divide the payment schedule but do not create a monthly subscription or a right to withdraw during the season.
Invoices are payable by the due date stated on the invoice and, unless agreed otherwise, before the first session. The participant bears bank or transaction charges imposed by their payment provider.
If payment is overdue, BVAZ may issue a reminder, suspend participation and retain the reserved place fee until payment is received. Statutory default interest may apply. Reasonable recovery costs caused by the delay may be charged where legally permissible.
Prices are stated in Swiss francs. Any applicable VAT will be shown on the invoice.
Participant absences
The seasonal fee reserves a place in a specific group for the full programme. Missed sessions due to holidays, work, travel, minor illness, scheduling conflicts or other personal reasons are not refundable and do not reduce the fee.
There is no automatic entitlement to attend another group as a make up session. BVAZ may exceptionally permit this when capacity, level and coaching quality allow, without creating a precedent.
Substitutes and transfer of a place
A participant who cannot attend may propose a suitable substitute. Every substitute requires prior approval from BVAZ and must provide identification and contact information, accept the applicable safety and participation terms, and meet the level requirements.
Unless BVAZ agrees otherwise in writing, the original participant remains the contractual party and remains responsible for the full seasonal fee. Any reimbursement between the original participant and the substitute is arranged directly between them; BVAZ is not party to that payment.
BVAZ may reject a substitute for reasons of safety, level, capacity, conduct or group compatibility. A permanent transfer of the remaining place requires written approval.
Injury, illness and early withdrawal
Short term injury or illness is treated as a participant absence under clause 5. The participant may use the substitute procedure in clause 6.
For a medically documented condition preventing participation for a substantial remainder of the season, BVAZ will reasonably assist with a permanent replacement. If BVAZ approves and fills the place, it may grant a proportional credit or refund for the recovered portion, less services already provided and reasonable administration costs. No refund is guaranteed while the place remains unfilled.
A participant who voluntarily withdraws for other reasons remains liable for the full seasonal fee unless BVAZ confirms a different arrangement in writing.
Cancellations and changes by BVAZ
If BVAZ cancels an individual session, it will first seek to provide a replacement session within a reasonable period. If no replacement is reasonably possible, BVAZ will provide a proportional credit or refund.
A replacement may take place at another reasonable time, at a nearby suitable venue or with another qualified coach. BVAZ will provide reasonable notice whenever circumstances permit.
If BVAZ permanently terminates a programme without equivalent replacement, prepaid fees for services not provided will be refunded.
Outdoor training, weather and venue decisions
Outdoor sessions may proceed in rain, wind, cold or heat when BVAZ considers conditions safe and the venue remains usable. Participants must bring suitable clothing, hydration and sun protection.
BVAZ decides whether conditions require cancellation, delay, relocation or modification. A participant's personal decision not to attend a session that proceeds does not create a refund entitlement.
If a venue operator closes the facility or conditions make the session unsafe, clause 8 applies.
Safety, health and participant conduct
Participants must follow coaching and venue safety instructions, use equipment appropriately and act respectfully toward coaches, other participants, venue staff and third parties.
Participants are responsible for assessing whether they are fit to participate and for informing the coach, before training, of relevant injuries, medical restrictions or other circumstances affecting safe participation. BVAZ does not provide medical diagnosis or treatment.
BVAZ may exclude a participant from a session where participation appears unsafe or where conduct materially disrupts the group. Serious or repeated misconduct may lead to termination after a warning where appropriate. No refund is due where termination results from serious breach, threats, harassment, violence or repeated disregard of safety instructions.
Sporting risk, insurance and liability
Beach volleyball involves ordinary sporting risks, including falls, collisions, impact injuries, overuse injuries and contact with sand, balls, nets, posts or other participants. Participation is voluntary and at the participant's own sporting risk.
Participants are responsible for maintaining adequate personal health and accident insurance. BVAZ insurance does not replace the participant's personal coverage.
BVAZ is liable in accordance with mandatory Swiss law. To the extent legally permissible, liability for slight negligence and for indirect or consequential loss is excluded. Nothing in these Terms excludes liability that cannot legally be excluded, including liability for intent or gross negligence.
BVAZ is not responsible for loss, theft or damage to personal belongings unless caused by conduct for which BVAZ is legally liable.
Force majeure
BVAZ is not liable for delay or failure caused by circumstances outside its reasonable control, including official restrictions, epidemic measures, extreme weather, infrastructure failure, prolonged venue closure or comparable events.
BVAZ will take reasonable steps to mitigate the impact and may provide replacement dates, alternative delivery, credit or another proportionate solution. Any statutory rights that cannot be excluded remain unaffected.
Personal data
BVAZ processes contact, enrolment, payment, attendance, level and relevant safety information to administer programmes, communicate with participants, issue invoices, manage substitutions, protect safety and comply with legal obligations.
Data may be shared with coaches, venues, payment and accounting providers and other service providers only as reasonably required for these purposes or as required by law. Participants must not use other participants' contact details for unrelated purposes.
Further details, including retention, service providers and participant rights, are set out in the BVAZ Privacy Notice.
Photographs and video
General programme participation does not require consent to promotional use of identifiable photographs or video. Marketing consent is requested separately and may be refused without affecting participation.
BVAZ may still create recordings where reasonably necessary for coaching analysis, safety or event documentation, subject to applicable law and the Privacy Notice. BVAZ will communicate the purpose and handling of such recordings.
Communications
BVAZ may send programme related messages by email, telephone or messaging services, including WhatsApp, using the details provided by the participant. Participants must promptly report changes to their contact details.
Operational messages concerning schedules, venues, coaches, safety, substitutions and invoices are part of the service and are distinct from optional marketing communications.
Intellectual property
BVAZ training plans, written materials, graphics, photographs, videos, logos and brand assets remain protected by applicable intellectual property rights. Participants may use materials supplied to them for personal, non commercial purposes only unless written permission is granted.
Complaints
Participants should raise concerns promptly by contacting info@bvazurich.ch. BVAZ will seek a practical solution and may request relevant details in writing. A sporting level or group placement disagreement alone does not constitute defective performance.
Amendments, severability and precedence
The version accepted at enrolment applies for the relevant season. BVAZ may update these Terms for future enrolments. Material changes affecting an existing agreement require an appropriate legal basis or the participant's agreement.
If a provision is invalid or unenforceable, the remaining provisions continue to apply. Mandatory law takes precedence over these Terms.
The Season Confirmation and any specific written agreement prevail over these Terms only for the matter expressly addressed.
Applicable law and jurisdiction
The agreement is governed by Swiss law. The competent courts are determined by mandatory law. Where a jurisdiction agreement is legally permitted, the courts at the Provider's registered place of business in the Canton of Zurich have jurisdiction.
